Terms of Use

By accessing or using Inkspire (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and contributors of the Service.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify users of material changes by updating the effective date above or by sending a notification through the Service.

You must be at least 13 years old to use Inkspire. If you are between 13 and 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet this eligibility requirement.

To access certain features you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain and promptly update your information to keep it accurate.
• Keep your password confidential and not share it with others.
• Notify us immediately at hello@inkspire.social if you suspect unauthorised access to your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to refuse registration or cancel accounts at our sole discretion, including accounts that violate these Terms.

Your ownership. You retain full ownership of any text, stories, threads, images, or other content ("User Content") you submit to Inkspire.

Licence to Inkspire. By submitting User Content, you grant Inkspire a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content solely in connection with operating and improving the Service. This licence ends when you delete your content or close your account, except where your content has been shared with others who have not deleted it.

Your representations. You represent that you own or have the necessary rights to all User Content you post, and that your content does not violate the rights of any third party or these Terms.

Collaborative stories. When you contribute a thread ("Continue") to another user's story, you acknowledge that your contribution becomes part of a collaborative work. Other contributors to the same story retain their respective rights to their own contributions.

You agree not to use the Service to:

• Post content that is illegal, defamatory, obscene, pornographic, threatening, harassing, or discriminatory.
• Infringe the intellectual property, privacy, or other rights of any third party.
• Impersonate any person or entity or misrepresent your affiliation.
• Upload malware, viruses, or any other harmful code.
• Engage in spamming, phishing, or any other unsolicited communications.
• Scrape, crawl, or otherwise access the Service by automated means without our prior written consent.
• Attempt to gain unauthorised access to any portion or feature of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any commercial purpose without our prior written consent.

The Inkspire name, logo, platform design, software, and all content provided by Inkspire (excluding User Content) are owned by or licensed to Inkspire and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our practices regarding the collection and use of your information.

The Service may contain links to third-party websites or services that are not owned or controlled by Inkspire. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We strongly advise you to review the terms and privacy policy of any third-party site you visit.

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

You may close your account at any time by contacting us at hello@inkspire.social. Upon termination, the licence granted to us under Section 4 survives only with respect to content you shared with others before closing your account.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Inkspire does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, Inkspire and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or relating to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from or relating to the Service shall not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).

You agree to indemnify, defend, and hold harmless Inkspire and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

These Terms are governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration or resolved in the courts of competent jurisdiction where Inkspire is based.

We reserve the right to modify these Terms at any time. Material changes will be communicated to registered users through the Service or by email. Your continued use of the Service following the posting of changes constitutes your acceptance of the new Terms.
